1. Which RCW allows us to “Piggyback” off of this contract?
RCW 39.34(5)(b) applies. It permits piggy backing provided the bid was properly issued by a public agency in the place of origin. In this instance, it is with the League of Cities. We have a letter from an attorney from the Northwest that speaks to the legal use of this contract. As with any contract, we urge you to seek independent review by your legal counsel to ensure compliance with all local and state solicitation requirements.

2. I understand this was an open and competitive bid. Who responded to it?
Of the four largest suppliers, Staples, Corporate Express and Office Max were responsive. Office Depot was included in the notification but did not submit a bid.

3. Was the Request for Bid/Proposal published in local newspapers and/or a public web site?
Yes. The RFP was published in the Daily Journal of Commerce on February 8, 2006. It was also posted on www.mynpp.com and www.orcities.org. The text of the published notice is available upon request.

5. I’m with a college. I’ve heard that only WIPHE members can negotiate on behalf of WIPHE members?
Correct. Only WIPHE members can negotiate on behalf of WIPHE members. But WIPHE members can piggy back off contracts of other jurisdictions per the RCW referenced below. The inclusion of the WIPHE members merely demonstrates that we included those members in the RFP so that vendors had notice that they potentially would be selling at the stated rates to those entities. But for an individual WIPHE member to utilize the League of Cities contract the WIPHE member would still need to sign the League of Cities IGA.
